1. Service Description

ETSS provides a case management and document generation platform for Employment Tribunal proceedings in England and Wales. The platform is a tool — it does not provide legal advice, representation, or guaranteed outcomes.

2. Not Legal Advice

ETSS is not a law firm and does not provide legal advice. Generated documents are templates and drafts that must be reviewed by the user before submission. You are responsible for all decisions regarding your case. We strongly recommend seeking independent legal advice from a qualified professional.

3. User Accounts

You must provide accurate information when registering. Solicitors must provide a valid SRA number. Barristers must provide a valid BSB Bar number. You are responsible for maintaining the security of your account credentials.

4. Subscription & Payment

Free accounts have limited features. Paid subscriptions are billed monthly via Stripe. You may cancel at any time — access continues until the end of the billing period. Refunds are provided for the first 14 days (cooling-off period per Consumer Contracts Regulations 2013).

5. Acceptable Use

You may not: use the platform for illegal purposes; attempt to access other users' data; reverse-engineer the platform; use automated scraping tools; or share account credentials.

6. Data Ownership

You retain full ownership of all data you input into ETSS. We do not claim any intellectual property rights over your case data, documents, or uploaded files. You grant us a limited licence to process your data solely for the purpose of providing the service.

7. Limitation of Liability

ETSS is provided "as is". We do not guarantee that generated documents are legally accurate or suitable for your specific circumstances. Our liability is limited to the subscription fees paid in the 12 months preceding any claim. We are not liable for missed deadlines, incorrect calculations, or adverse case outcomes.

8. Availability

We aim for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be notified in advance where possible.

9. Dispute Resolution

Any dispute, claim, or controversy arising out of or in connection with these terms or the use of the ETSS platform shall be resolved in accordance with the following procedure:

9.1 Negotiation. The parties shall first attempt to resolve any dispute through good-faith negotiation. The aggrieved party shall provide written notice of the dispute to the other party, setting out the nature of the dispute and the relief sought. The parties shall use reasonable endeavours to resolve the dispute within 30 days of such notice.

9.2 Mediation. If the dispute is not resolved by negotiation within 30 days, the parties agree to submit the dispute to mediation administered by the Centre for Effective Dispute Resolution (CEDR) in accordance with its Model Mediation Procedure. The mediation shall take place in London, England. The costs of mediation shall be shared equally between the parties unless the mediator directs otherwise.

9.3 Condition Precedent. Both parties agree that compliance with sections 9.1 and 9.2 above is a condition precedent to the commencement of any court proceedings. Neither party may issue civil proceedings in relation to any dispute arising under these terms unless and until the negotiation and mediation procedures set out above have been exhausted or the other party has failed to participate in the mediation within 14 days of a request to do so.

9.4 Exceptions. Nothing in this clause shall prevent either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction where necessary to protect its rights.

10. Governing Law

These terms are governed by the laws of England and Wales. Subject to the dispute resolution procedure in section 9, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to Terms

We may update these terms with 30 days' notice via email. Continued use after the notice period constitutes acceptance.
